Associate Prof. Xie Libin gave a lecture on Fundamental Rights of Constitutional Commission to the students of School of Law, Nanjing University on the evening of 18 October. Associate Prof. Zhang Wei from the school moderated the seminar.
For the start, Xie introduced the College of Comparative Law of China University of Political Science and Law, in specific the admission situation of Sino-German Institute of Law and Sino-American Institute of Law in the college. He extended his welcome on behalf of the college to Nanjing students, the latter also showed their interest in the course of comparative law.
During the lecture, Prof. Xie discussed whether the fundamental rights in the Chinese Constitution have a positive effect on state laws and other legal mechanism which, according to constitutional principles, cannot violate the individual rights articulated in China's National Constitution. He also talked about the tension which can exist in balancing for example the right to freedom of speech and the protecting the dignity of the individual's reputation. He commented on the interdependence of the various relations acting within the larger context of the law; For example, in a marriage or contract it takes both parties to comply in order for the relationship to be harmonious and successful.
Xie ended the speech with answering questions from the audiences.
